Oscar Pistorious will most likely serve less time than Evans and Tyson and possibly go back to his track career. He actually killed his girlfriend. Another view point to consider. Accidentally though. Big difference. You can't rape a woman by accident. To be honest, I am sceptical of any allegation against someone famous unless the evidence is irrefutable. The fact that The Court found him guilty is a big thing for me.

The fact that The Court found him guilty is a big thing for me. Is lack of concent always rape? I honestly think lack of consent should be a totally different thing. At worse I think that Evans believed he had consent whereas she feels she didn't because she can't remember what happened. For me there is a difference (would still be guilty). In the US they have come up with the yes means yes law. I'm not about the specifics but imo if you don't get the clear consent you should be tried for that. Rape should be left as physically taking sex when lack of consent is obvious. Does that make sense?

In our legislation, no consent = rape.
"Rape
(1) A person (A) commits an offence if— (a) he intentionally penetrates the vagina, anus or mouth of another person (B) with his penis, (b) B does not consent to the penetration, and (c) A does not reasonably believe that B consents. (2) Whether a belief is reasonable is to be determined having regard to all the circumstances, including any steps A has taken to ascertain whether B consents. (3) Sections 75 and 76 apply to an offence under this section. (4) A person guilty of an offence under this section is liable, on conviction on indictment, to imprisonment for life."
For some reason I always find it grimly amusing that you can't rape someone's ear.

A woman cannot be guilty of rape. There has to be penetration, with an actual penis before you ask about strap-ons. The worst a woman can be convicted of is sexual assault.
It's actually a pretty huge gap in criminal law in my view.

Rape is rape. He shows absolutely no remorse. Unlike so many bullshit claims against footballers/celebrities, this guy was convicted in a Court of Law. The 'time' he served was a joke anyway. Getting paid to play football is a privilege, a gift. You rape someone, you forfeit that privilege. Perfectly decent people break legs at 20 and never go on to have the career they should have. The girl had made several claims before and tweeted about how happy she was to be getting a pay day out of it. There was nothing violent about the crime. She went to his hotel room voluntarily and then woke up and said she didn't remember anything. No drugs were found in her system and no alcohol either. New video evidence shows she didn't even look intoxicated when entering the hotel room. If he loses his appeal then he's made a disgusting mistake but not something he can't come back from. Brendan Rodgers son imo did the exact same thing. Better Lawyers equals not guilty and allowed to keep playing football. Have you studied the case? His initial appeal was thrown out, because of the evidence against him. He even admitted the girl did not give consent, there was no implied consent. like there was with the other lad, as they were all over each other earlier in the night. People who are being apologists and blaming the girl can fight me!

there's no question of him being allowed to return. he can go play wherever he wants.
the problem is that clubs won't take him due to the impact their reputation and attraction to sponsors will take.
being a pro footballer is a job and pro football is an industry. if you're good enough (or perceived to be good enough), there's likely somebody out there that will sign you. he has the right to go back to work.
as for going to another country, unless he has the right in the EU, i'd imagine his conviction would prevent him from obtaining a visa in places like the US, Canada, Australia and maybe even India/China (up and coming leagues). so ironically there's more legal issues to the suggested alternative than there is him playing in England.

I remember that from when my SO was doing her law degree, I can't remember though if theres actually a sentencing power difference and it just terminology? I also remember that it was until c.1990 (I think) a husband could not rape his wife.
